What is an LMIA?
A Labour Market Impact Assessment (LMIA) is a document that most Canadian employers need before hiring a foreign worker. It shows that hiring a foreign worker will not negatively affect Canada’s job market — meaning there is a genuine need for the position and no Canadians or permanent residents are available to fill it.
Why it Matters
Employment and Social Development Canada (ESDC) uses the LMIA to ensure fairness in the labour market. A positive LMIA (also known as an “approval”) gives the employer permission to hire a foreign worker under specific terms.
LMIA Basics for Employers
To obtain an LMIA, employers must:
- Prove recruitment efforts were made to hire Canadians first
- Offer wages and working conditions consistent with industry standards
- Provide a legitimate, full-time job offer
- Comply with all federal and provincial labour laws
Once the LMIA is approved, the foreign worker can apply for a work permit using the LMIA confirmation letter and job offer
Employer Compliance
After hiring a foreign worker, employers must continue to follow program rules and maintain compliance. This includes:
- Keeping records related to recruitment, wages, and employment conditions
- Ensuring the worker performs only the job approved in the LMIA
- Paying the wage rate listed in the LMIA
- Cooperating with any compliance inspections from ESDC
Non-compliance can result in penalties, bans from hiring foreign workers, and loss of LMIA privileges. It is important to stay organized and proactive.
How Immigration Care Can Help
We guide employers through every step of the LMIA process, from application preparation to post-approval compliance. We help make sure your documents are accurate, your recruitment efforts meet government standards, and that you understand your ongoing responsibilities.
Hiring Temporary Foreign Workers
When there is not a suitable Canadian candidate available to fill certain jobs, employers can hire temporary foreign workers through the Temporary Foreign Worker Program (TFWP).
This program allows employers to bring in workers for roles in sectors such as:
- Agriculture and food processing
- Construction and trades
- Health care and caregiving
- Hospitality and tourism
Key steps for employers:
- Determine if an LMIA is required
- Prepare and submit the LMIA application (if applicable)
- Provide the worker with a job offer and supporting documents
- Ensure the worker applies for a valid work permit
Hiring Permanent Foreign Workers
For long-term or high-skilled positions, employers may hire foreign workers who plan to become permanent residents through programs such as:
- The Express Entry system (via arranged employment offers)
- The Provincial Nominee Program (PNP), where provinces nominate workers for permanent residence based on local labour needs
Employers can play a vital role by offering permanent job opportunities that help skilled workers transition to life and work in Canada.
Our Approach
Immigration Care helps employers understand which program fits their hiring needs, ensures applications are complete and compliant, and supports both the employer and worker through the transition from temporary to permanent status.
